Overview

Kiera Murphy helps health care–related companies create calculated plays to tackle high-stakes disputes and commercial litigation, working primarily for health insurance and pharmacy benefit manager clients. Building off her broad experience, she has skillfully produced positive results throughout her tenure at the firm.

Positive Results

Kiera’s experience includes:

  1. Working as the lead associate on a commercial arbitration for a Fortune 5 company with 10-figures of damages at issue, with successful resolution of the case.
  2. Leading discovery that involved collection from nearly 60 custodians, offensive and defensive motions to compel, potential spoliation issues, and extensive third-party discovery.
  3. Second-chairing the deposition defense of several C-suite executives.
  4. First-chairing multiple evidentiary hearings, obtaining favorable outcomes and dismissals.
  5. Counseling a Fortune 50 company on privilege issues, as well as presenting to the company’s full legal department on dual-purpose communications.
  6. Briefing and arguing a motion for default judgment in federal court, resulting in entry of default and default judgment.
  7. Briefing and arguing a motion to quash a nonparty deposition subpoena for a Fortune 500 company, resulting in the federal magistrate judge allowing only one narrowed topic.
  8. Briefing and arguing a motion to dismiss, which resulted in a complete dismissal from the breach-of-contract action.
  9. Briefing and arguing the opposition to a motion to vacate, resulting in denial of the motion.

Prior Experience

A two-time summer associate with the firm, Kiera rejoined Faegre Drinker following a legal externship with the U.S. Attorney’s Office for the District of Minnesota. During her externship, Kiera drafted a successful motion to dismiss a lawsuit against a federal agency and assisted with cases involving terrorism and child exploitation issues.

She gained experience developing risk management strategies, supporting litigation strategy and constructing defensive themes through a judicial externship with the Hon. Paul A. Magnuson of the U.S. District Court of Minnesota, as well as through legal internships with Hormel Foods and Target.
