Claudia Schultze, Ph.D.
Senior Intellectual Property Attorney
Overview
Claudia provides intellectual property counsel and opinions, including analyzing patent validity and invalidity, freedom to operate and noninfringement, and helps clients grow and protect their intellectual property worldwide through the strategic preparation and prosecution of U.S. and foreign patent applications. She has extensive experience in chemical arts. Claudia drafts and prosecutes applications in a wide range of chemicals and material sciences, including, for example, small molecules (such as fluorine and aroma chemicals, surfactants, and pharmaceuticals), large molecules (Organic chemicals for OLEDs and a wide variety of polymer chemistries) and chemical compositions, as well as production, applications and end uses, chemical processes from bench top to large scale commercial production facilities and medical devices.
In addition, she provides counsel regarding corporate internal best practices, including invention disclosure procedures, intellectual property portfolio management and intellectual property/employment law issues. She also assesses patent portfolios of competitors and potential acquisition targets.
Claudia also has extensive litigation experience in the chemical and pharmaceutical fields.

- In re Certain Dental Ceramics, Products Thereof, and Methods of Making the Same, Inv. No. 337-TA-1050
- Represented large German chemical company in patent infringement matter (Evonik Degussa GmbH v. Materia Inc, Civ. Action No. 09-cv-636)
- Represented German company before the International Trade Commission (ITC) under Section 337 of the Tariff Act (No. 337-TA-756), and was part of a team representing Ortho-McNeil (which sold once-daily tramadol (branded as Ultram® ER) under a license from Purdue) in an ANDA litigation (Purdue Pharma Prods. L.P. v. Par Pharm., Inc., 642 F. Supp. 2d 329 (D. Del. 2009))
- Represented defendants Julius Glatz GmbH, LIPtec GmbH and KneX Worldwide LLC in a patent infringement litigation relating to cigarette paper wrappers, which resulted in the ITC affirming the administrative law judge’s finding of no infringement of one patent in the suit, and invalidity of the second patent in the suit (Certain Reduced Ignition Proclivity Cigarette Paper Wrappers and Products Containing Same, Inv. No. 337-TA-756)
- Represented Seruga (individually and as sole shareholder of Excellent Bakery Equipment Co., and Excellent Bakery Equipment Co., a New Jersey corporation) in a trademark litigation (Zinn vs. Seruga)
Prior Experience
During law school, Claudia served as a judicial extern to the Honorable Kent A. Jordan in the U.S. District Court for the District of Delaware. Prior to joining Faegre Drinker, she worked for INVISTA, North America, S.a.r.l. (formerly DuPont Textiles), as a senior research engineer and market development manager for six years. Her research initiatives led to numerous patents and the development of new fiber and consumer products in the medical field and sports apparel. Claudia has authored numerous scientific articles, a book chapter and presentations, and has presented her research both nationally and internationally.
