3M acquired Ivera Medical Corp., a successful startup company that makes disinfecting caps for intravascular (IV) catheters. As part of its emergence, Ivera was involved in substantial patent litigation across the U.S.: four pending Federal Circuit appeals, two district court cases in the Southern District of California, and one district court case in the District of Utah.
Prior to our firm's involvement, Ivera had lost significant issues in its patent cases, including the Southern District of California granting summary judgment of invalidity of three of Ivera’s patents. Our firm won a claim construction order in one of the cases, convinced a judge to deny a defendant's motion for summary judgment (thereby sending another case to trial), and argued and won a reversal by the Federal Circuit of the district court's summary judgment order of invalidity.
