In a case-ending victory for our client Cargill, the United States Court of Appeals for the Fifth Circuit affirmed a grant of summary judgment in Cargill’s favor. Plaintiffs had sought $238 million in damages for alleged lost profits and lost business value arising out of their failed plan to build an oil terminal on the Gulf Coast. After summary judgment was entered for Cargill, Plaintiffs appealed. Our firm defended the appeal for Cargill, and after full briefing and argument, the Fifth Circuit summarily affirmed the judgment in Cargill’s favor.
