It has been almost three months since the Supreme Court decided Students for Fair Admissions, effectively striking down race-conscious admissions programs in higher education. While the immediate impact of this ruling is largely confined to higher education, it raises questions as to how follow-up litigation could impact the nonprofit sector, especially as it relates to diversity, equity and inclusion initiatives and the use of race as a consideration in grantmaking, programs or contracting.
As the dust continues to settle, join Joseph Miller, Angela Fogt, and Jane Dall Wilson as they discuss this new legal landscape and the questions that it raises for the nonprofit sector. We will also share observations on how some nonprofit organizations are responding to these rulings, and we will provide some suggestions for mitigating litigation risk going forward.
