The Defend Trade Secrets Act: Comparing the New Federal Statute with the UTSA

Dallas associate Alex Harrell co-wrote “The Defend Trade Secrets Act: Comparing the New Federal Statute with the UTSA” for the April 2017 edition of the Texas Bar Journal, republished in the October 2017 issue of The Computer & Internet Lawyer.

In May 2016, President Obama signed into law the Defend Trade Secrets Act of 2016, which established the first federal private right of action for trade secret misappropriation. Before this legislation, trade secret misappropriation was firmly in the domain of the states, most of which have adopted the Uniform Trade Secrets Act. This article analyzes the newer legislation and highlights some significant differences between the new federal statute and the UTSA.
