In Competition Policy International (CPI), partner Alicia Batts and associate Alison Agnew published “Consent Decrees Under the Biden Administration” inspecting the impact of refreshed Biden Administration competition policies on recent agency practices and enforcement actions.
According to the authors, “Although the Biden Administration antitrust enforcement agencies have changed policies and aggressively investigated and litigated mergers that raised anticompetitive issues, both agencies continue to consider and enter into consent orders — sometimes by choice and sometimes during challenging litigation with unknown outcomes.”
In the article, the authors discuss the Biden administration antitrust policy, rapid changes in long-standing policies and Biden consent decrees and fix-it-first divestitures.
