Class Actions/Consumer Disputes
Matt defends class actions and consumer disputes involving privacy, technology, sales and advertising practices, ADA Title III compliance, product defects, and various federal and state consumer protection laws. He has handled matters involving false advertising, telemarketing, privacy, consumer lending, gift cards, website accessibility, public accommodation accessibility, breach of warranty, deceptive trade practices, and RICO. And Matt has extensive experience with numerous federal and state consumer protection laws that are frequently used to target businesses, such as the Telephone Consumer Protection Act (TCPA), New Jersey Consumer Fraud Act (CFA), New Jersey Truth-in-Consumer Contract Warranty and Notice Act (TCCWNA), New Jersey Consumer Service Contract Act (CSCA), the Americans with Disabilities Act (ADA), California Consumer Privacy Act (CCPA), California Unruh Civil Rights Act, Biometric Information Privacy Act (BIPA), New York Deceptive Trade Practices and False Advertising laws (General Business Law §§ 349, 350), Fair Credit Reporting Act (FCRA), Fair and Accurate Credit Transactions Act (FACTA), and Fair Debt Collection Practices Act (FDPA).
Complex Litigation/Internal Investigations
Matt represents clients in complex litigation, arbitration and internal investigations involving contract disputes, fraud, telecommunications and technology issues, breach of fiduciary duty, accounting and corporate governance issues, franchise disputes, products liability and mass tort, tortious interference, unfair competition, antitrust, trade libel/defamation, Lanham Act, noncompete and nonsolicitation, employment disputes, misappropriation of trade secrets and insurance coverage.
Compliance/Counseling
Matt understands key issues and risks that business face with emerging technologies such as Connected Devices, the Internet of Things, Artificial Intelligence, App Privacy, Mobile Tracking, and Biometrics. He frequently counsels clients regarding compliance with consumer protection and privacy laws, sales and advertising practices, telemarketing practices, consumer contract disclosures, website terms and conditions, and arbitration clauses. He negotiates, drafts and closes transactions involving sales agent and reseller agreements, product distribution agreements, participant waivers and releases, nondisclosure agreements, indemnity agreements, asset purchase agreements and vendor agreements.
