In today's technology-rich environment, data is a high-value business asset that warrants protection. Regardless of whether a company seeks to use data from other sources or has its own database that can be leveraged through licensing to third parties, the contract and compliance considerations regarding the protection and treatment of data and related intellectual property are vast and complex. In this Interface program, we will explore the key contracting and compliance considerations that companies should consider (inbound and outbound) whenever data is being licensed — including under dedicated data license agreements and other relevant arrangements, such as subscription agreements, website terms of use, outsourcing agreements, purchase and sale agreements, alliance agreements and other commercial agreements.
