Overview

Christine Werner advises insurance industry clients on state and federal regulatory and transactional matters. She helps clients tackle both routine and challenging regulatory issues related to licensing, products, compliance, contracting, holding company transactions, state department of insurance filings, surplus lines industry matters and insolvency matters.

Licensing

Christine has formed and obtained licenses for insurance companies, HMOs, third party administrators, insurance agencies and other entities, and has assisted clients in complying with ever-changing requirements to maintain such licenses.

Products

Christine helps clients draft major medical and standalone dental products, life insurance products, and property and casualty products. She advises clients on annual rate and form filings through SERFF. 

Compliance

Christine helps insurance companies, HMOs, third party administrators, and producers (including limited lines producers and surplus lines producers) interpret and comply with state insurance laws, including those related to the regulation of insurance holding companies and transactions among affiliated entities and contracting issues. Christine also has experience advising on the often gray area of what constitutes a product warranty versus a service contract.

Department of Insurance Filings

Christine works with state insurance departments across the country and advises clients with regard to myriad regulatory filings facing the life and health, property and casualty and surplus lines industries. 

Surplus Lines

Christine advises surplus lines brokers with issues related to the ability to charge fees to customers, evaluating the requirements related to surplus lines broker’s diligent effort and declinations obligations, and helping brokers understand the exemptions available when selling to commercial purchasers. 

Factoring Transactions

Christine represents insurers with regard to issues related to the factoring of structured settlement annuity payments, including the assignment of payments, various beneficiary and estate issues, and overpayment recovery.
