Overview
As a product liability litigator, Traci McKee defends medical devices and pharmaceutical products that save lives and consumer products that enhance lives. She represents product manufacturers in complex, high stakes litigation such as mass torts and class actions, as well as single-plaintiff claims. With more than a decade of litigation practice, Traci has substantial experience in all phases of litigation from discovery through trial, having served as first chair and second chair in multiple jury trials. She understands the strategies and goals of the clients she represents and develops tailored litigation strategies focused on each client’s business goals.
Medical Device and Pharmaceutical Litigation
With the Faegre Drinker team, Traci defends and coordinates mass tort and multidistrict litigation across the United States and in Canada, particularly on behalf of large medical device and pharmaceutical makers. She helps clients pursue alternative dispute resolution strategies when aligned with their business interests — and boldly presents a strong defense at trial when appropriate for the client.
Consumer Products
Traci also defends consumer product manufacturers in high-exposure personal injury and property damage lawsuits. She has represented manufacturers of products ranging from above-ground pools and pool products to HVAC and other residential products. Throughout her career, Traci has defended clients in high stakes cases involving personal transportation devices, automobiles, motorcycles and bicycles, many of which involved catastrophic injuries such as traumatic brain injuries, spinal cord injuries and death. Traci also has substantial experience defending claims alleging severe physical, mental and emotional injuries to minor children.
General Litigation
In addition to product liability litigation, Traci has represented individuals, corporations and governmental entities in professional malpractice, premises liability and employment claims. Traci represented several local school boards and organizations tasked with the responsibility of caring for children in their custody. She argued multiple cases in the Second District Court of Appeals in Florida and argued a case to the Florida Supreme Court.
Before her legal career, Traci gained valuable experience working as a claims specialist for State Farm Insurance Company where she investigated, evaluated and oversaw litigation of personal injury and property damage claims arising out of automobile accidents.
Personal Interests
A native Floridian, Traci enjoys living in Fort Myers with her husband, Rusty, and two sons, Brett and Braden. She is a former Women’s Volleyball Team captain at the University of North Florida.
